PS: Remember, all they have to do to get out of this mess is add "Based on the game TREADMARKS by Longbow Digital Arts". It happens with books to movie conversions and movies to game conversions where things are slightly different...

Matrix, there is one difficulty with that comment. Those people have almost without question gotten permission by the original "artists" to use their intelectual property. Therefore to put that statement on it would be to admit to having used that property, and if they hadn't gotten that permission then it would be tanamount to admission of guilt.

stealing sourcecode IS a major offence as well. Remember HL2? ANY game using ANY of that code is liable, and Valve can sue for copywrite violations.

If they let them get away with it now with the conversion to the various console games = they lose alot of standing if they switch over to PC. Just saying "Based on TM" would not be much of a defense since they would likely be held to a "higher" standard since they did have the source code for so long. A successful version of TM for console I am sure would do much to increase the bottomnline money wise for LDA. Just look at the guys who won against Taco Bell for the talking chihuahua thing. JT

Sure, if they made their own game, yea, fine. no one can sue for a simular game play.

but using the actual CODE would be the problem here.

it doesnt even have to be exactly the same code...if the code is similar then its theft.

in the case of the xbox and linux exploits, any code that is derived or built from the xbox's bios, rom, ect is illegal...

theres the whole fight over unix right now...sco is it? is now suing everyone who used their code to build linux and other unix systems.

At one time there were two specific tex mex rest in tx - one just basically copied the layout and theme of the other and they lost in and went bankrupt pretty much. Sad thing was they did a much better job of the rest thing. Understand that restaurants and source code two different things - just shows that the similarities if high enought one can get screwed lol JT

Since when was Linux closed code ? - i thought the whole point was to take the last version of whatever part, iomprove it and release it...

if there is a new addons pack id like to get these tanks ive been working on to you all at LDA. not done yet ,but ive got about 16 done so far .
ones to do yet are
M1, T72, Talon, distroyer .
no liquid tanks.

And its sad that MS makers stole this "idea" of MS from a cute little game called TM . but all thats well ends well .
i cant wait to get online agine...liven in the boonies is harming my DDM time.

I was doing a little reading on TM and stumbled upon this old topic. Have there been any updates on the matter? I read on the MS press release that "Everything in our game can be shot, blasted, shifted or

is literally the case that no two games are the same.", which is Ironic because you can easily see the TM within (I know that it wasn't written to compare both games... but still). Has this battle for copyright been forgotten? Abandoned?

Given that they didnt follow up a terrible breech of contract by Reprocity Software who were the original dev team for the PS2 version, i think its unlikly they will take any action against Tantalus. Still ... we can only hope.
